TERMS AND CONDITIONS

Our company name is MY WAY DIARIES S.R.L., with CUI  39448574, social capital 200 Lei, registered under J12/2417/06.06.2018 and address Aleea Rasinari, Nr 4, Ap16, Cluj-Napoca, Romania.
All rights reserved for all website content and all the products sold on the website @ MY WAY DIARIES S.R.L.

No part of the products may be reproduced or transmitted in any form or by any means, electronic or mechanical, including photocopy or any storage and retrieval system, without prior written permission from the author.

All products are based on the author’s personal experience, learnings, and current beliefs. While the author tried her best to build, structure and offer content generic enough to serve as many people as possible, it doesn’t claim perfection. This is why it cannot offer any guarantee for the correctness and completeness of the content. Nor for the user’s success following the guidance provided in the diary. No liability will be accepted for any issues, loss, damage of any kind related directly or indirectly to the usage of the products.

The Site can be accessed in the entire world. In case the site is accessed outside Romania, the client carries full responsibility to respect the local law of the country where the products are shipped and from where he accesses the Site.
For justified reasons, MY WAY DIARIES S.R.L. can restrict Client access to order to some of the payments methods as a result of Client behavior that might harm MY WAY DIARIES S.R.L.

Proceeding with the order the client accepts without objections current terms and conditions having a value same as a Contract.



PAYMENTS and DELIVERY

Since everything is done either by me or a very small numbers of collaborators, processing and handling your order may take 3-5 working days, from the moment the order and payment are confirmed.

Payment is done with debit/credit card through Netopia mobilPay.

The default currency used by Netopia to charge you for the purchases you make in our online shop is LEI (RON – Romanian currency). 

Please see link to NBR’s website here for exchange rates. Other fees may apply due to your bank’s exchange rate fees. For details, check with your bank.

 

Delivery is done with Sameday Courier, only in ROMANIA Estimated delivery time is 3-5 working days after your order is confirmed. (20 RON for orders below 150 RON and Free Shipping for orders above 150 RON).
 
If we cannot fulfill the order in 7 days we will inform you via email and will return the money in the account the payment was made from.
Not picking up the package from the delivery company in 7 days it will cancel the order and the money will be returned in the same account the payments was made form.

RETURNS

According to O.U.G 34/2014 in Romania you have the right to request a return for a purchase without a reason.

To be eligible for a return, your item must be unused and in the same condition that you received it.  And because they are stationery products there is no warranty period for our products.

Our policy lasts 14 days. If 14 days have gone by since your purchase, unfortunately, we can’t offer you a refund or exchange.
To complete your return, please email us at contact@mywaydiaries.com, and attach a receipt or proof of purchase.

Refunds (if applicable)
Once your return is received and inspected, we will reply to your email with a notification that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next, contact your bank. There is often some processing time before a refund is posted.
If you’ve done all of this and you still have not received your refund yet, please contact us at contact@mywaydiaries.com.

Shipping
You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
Depending on where you live, the time it may take for your exchanged product to reach you may vary.
Consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

PRIVACY

According to Laws nr. 677.2001 and nr. 506/2004 MY WAY DIARIES S.R.L. is obliged to administer your personal data provided in a safe way, in the specified conditions.

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from https://mywaydiaries.com (the “Site”).

CONSENT
How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.
If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent or provide you with an opportunity to say no.
How do I withdraw my consent?

Payment is done with a debit/credit card through our partners NETOPIA mobilPay. We don't manage nor have access to your payment card data.
 
When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

HOW DO WE USE YOUR PERSONAL INFORMATION?
We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
- Communicate with you;
- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

We also share your Personal Information with our Delivery partner, Sameday Courier https://www.sameday.ro/noutati/politica-de-confidentialitate-a-datelor-cu-caracter-personal to be able to ship the orders and with  Netopia mobilPay https://www.mobilpay.ro/public/en/ for online payments
 
We might send some of your Personal Information to authorities or public institutions when the law requires (ex. investigating fraud, anti-money laundry, financial situations to financial authorities, etc.. ) or to justice institutions if needed for defense in court or to other public institutions.

YOUR RIGHTS
If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.
Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION
When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.



CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website.



MINORS

MAJOR FORCE

No party will be responsible for not executing the obligations if this is due to a major force event. Major force event is unpredictable and outside of the parties control.
If in 15 days since it was produced doesn't stop each party has the right to notify the other party about the termination of the contract without any of the parties to claim damages or interest.
